Legal Question in Criminal Law in Florida

Child Support Vs. Order of Protection

My ex husband owes me over 70K in C.S. He claims that if I don't drop the restraining order, he can't geta CDL and get a job. Is this true? Although he has worked as a computer analyst for 20 yrs, he now says he is out of work and needs to be a truck driver. Is he just pulling the wool over my eyes, so that I will drop the order of protection? He claims that if I do, he'll get the job and then pay child support. I haven't gotten support from him in over 13 years.

This does not sound legitimate to me. Non payment of child support may have some effect and even serve to suspend his license but not a restraining order. Either he is confusing the facts or he is purposely trying to mislead you.

Re: Child Support Vs. Order of Protection

Injunctions for Protection (restraining orders) have no effect on a driver's license, CDL or otherwise. Back child support can suspend a driver's license, though, if the amount due exceeds $2,500. Maybe he got confused and wants you to drop the back child support instead of the injunction for protection. Don't drop the injunction. For that matter, you probably shouldn't drop the back support, either.
