Domestic Battery

Hi, I am a alleged victim in a case involving domestic battery. There was a phone call made from my neighbor (who doesn't like us) to 911 claiming that she had witnessed my husband allegedly hitting me ''several times in the face.'' When the police showed up I had absolutely no marks on my face and my husband and I were not even fighting. He is scheduled for trial in a week and I will be testifying on his behalf. I have written the states attorney and asked that the state not pursue the charges. What are the possible outcomes of this??? Please Help!!!!

Assuming there are no other witnesses, and you don't testify against him, it is likely he will be found not guilty. Of course, it all depends on what the neighbor has to say.

It's curious, of course, that your neighbor--no matter how much he doesn't like you--would just call out of the blue to accuse your husband of beating you.

I have no idea if you're telling the truth, but if you're lying, and her husband is found not guilty, he probably won't get the treatment he needs to control his anger, giving both of you a better life. Moreover, if you're lying, who knows what will happen the next time he beats you?
