Legal Question in DUI Law in Florida

I will sonn be convicted of a DUI in Florida. The charge in a nd offense with the first more than 10 yrs prior. DMV suspended my license for 1 yr. Can I get a hardship after completeing driving school,paying fines ect? Also there does not seem to be a minimum for jail time. Does that mean jail is not reuired and if I am sent to jail, what alternatives could I ask for that would allow me to keep my job.

If you have an attorney you should ask him/her this question. But, yes, you should be able to get a hardship license. There is no minimum jail time, and the maximum jail would be 9 months. Jail is not required. What alternatives to jail you have would depend on the location of the offense. Talk to your attorney. Good luck.

Mr. Waggoner is correct (as usual) about everything, except for one detail that may have been misunderstood from your question. If this is a second or more DUI, then you can NOT get a hardship for the first year.
