adoption

I was granted custody by the state of Ga for my grandkids about a year and a half ago. My boyfriend of 10 years has been the only father they have known but is not mentioned in the state custody papers. Is it possible for him to adopt the kids even if we arent married? Or what can we do to make sure these children are safe with him should anything happen to me?

In order for you and your boyfriend to adopt the Grandkids, the parental rights of the childrens'parents would need to be terminated by a Court. Short of a termination proceeding, the parents would need to execute waiver of rights. It would also be helpful if you and your boyfriend were married.

Technically, it is possible for him to adopt, but I think it's unlikely. First, I'm not sure what your custody status is since I'm not sure how Georgia law works. (For instance, have the biolical parents' rights been terminated?) Second, judges almost never allow adoptions to unmarried persons in situations such as yours.
