If you feel this will be an ongoing problem in the future, you can bring on a Contempt of Court proceeding to enforce your written marriage agreement.

If there is No Court Order/Judgment addressing custody and visitation (Parenting Plan with Time Sharing) and the child was not born in wedlock, the mother is the natural and legal guardian of the child and if you call the police they will advise that the child has to remain with her.

You can change this by filing a Petition to Establish Paternity and for a Patenting Plan with Time Sharing. The court will declare you as the Father and put in place a visitation schedule. Please note that the court will also review and assess child support.

If there is already a Time Sharing (visitation) schedule in place then you must file a Petition for Contempt or Enforcement citing this past weekend as evidence of noncompliance.
