Legal Question in Civil Litigation in Florida

Exploitation of Mentally retarded son

Our son who is 28 yrs old and is mildly retarded has been exploited, we feel, by 2 adults. In past 5 years he has given to them his savings of approx.$9000, bought them gifts-debt of 14 thousand. He does not realize what they have done to him. Other than working with Child and Family services, should we get an attorney and what if any can be done to these people?

Re: Exploitation of Mentally retarded son

This is a very serious and complex legal problem. From the limited information provided, it sounds as if you should meet with a probate and guardianship attorney and have a guardian appointed and your son declared legally incompetent. The guardian could then act on behalf of your son and explore the possibility of any legal action to obtain his money or other property back. Without a guardianship, your hands are probably tied.
