Legal Question in Landlord & Tenant Law in Florida

I am a landlord and have evicted tenants for non-payment of rent. My question is in this economy the tenants come and then 2 or 3 months later leave. Can I put a lien on a person since they don't own property for the remainder of the rent? Thanks Kathy

You have to sue them first, but once you have a judgment, you can file a lien against them. Of course, you may just be throwing good money after bad and wasting your time going after people who have no money or property anyway.

No. You can get a judgment, but you need to sue first. It may not be worth your time or effort to do so.

You have to file in court and get a judgment against them. That being said, you will be required to mitigate damages by finding a new tenant. There is free information on Florida Landlord-Tenant law at http://www.800helpfla.com/landlord_text.html.
