Legal Question in Medical Malpractice in Florida

Misdiagnosis of child brought into emergency room

Child falls while rollerblading. Hits head

unconcious when mom finds. Taken to emergency

room. Told to take child to dentist in morning.

Front teeth are broken. Released. Mom takes child to oral surgeon next morning. Surgeon

tells mom, should not have been relased from

hospital, broken jaw. Teeth could possibly have

been saved day of accident. Three more teeth now

must be fixed. Root canals and caps. All very

expensive. Should this all be covered by home owners insurance? Mom has health insurance, but this was an accident. What responsibility does hospital carry? If fixed that evening, child would not have suffered physically, teeth probably would have been saved. Mom has problem

with misdiagnosis. What can she do?
