is it legal to amend the declaration of documents regarding ''nuisance'':

''maintainging and keeping more than one domestic pet, whether dog or cat, in an apartment shall be conclusively presumed to be a nuisance and shall not be permitted.''

Not if amendment is done properly. it should not effect those already in violation

The Association has the right to amend any part of the condominium documents. A majority as set forth in the documents is required. Any meeting to consider the proposed amendment(s) must be clearly and properly advertised or noticed to all members of the association.
