Legal Question in Real Estate Law in Florida

Ripped Off By Mortgage Company

At the time our divorce was going on, my husband and I owned a home free and clear. At the divorce hearing, my husband testified he had been trying to take out a mortgage on the house. The judge ordered him not to take out a mortgage as it was the only asset left that he had not liquidated. Two weeks later, my husband managed to get a mortgage and took out most of the equity in the house. If the mortgage company had bothered to read the court documents - which they apparently had in their possession - they would have known that most of the equity in the house had been awarded to me. As a result, I received a small amount from the sale of the house when the court forced the sale of it - because the mortgage my husband took out had to be paid. I consulted an attorney at a cost of $100.00 who wrote the mortgage company a letter and they said they were prepared to fight me. I can't afford to retain an attorney as I am currently unemployed and because my divorce cost me over $30,000.00. Is there anything I can do about this mortgage company on my own for their incompetence? I am furious that they cost me my share of the house proceeds. Please let me know how I can do this on my own. Thank you so much. Kathleen Wells
