squatters rights

if someone has a fence on your land and has had it like that since you moved in approx 5 yrs ago....is that now his land or can I take possession of the land?

Five years is not enough time for squatter's rights (we call it "adverse possession") to apply. You should talk to a real estate lawyer right away before you just tear down the fence.
