There is a recent appellate case that says that if the worker did not file for taxes, his avereage weekly wages are $0. So in short, yes, an illegal who does not file taxes can end up getting no wages but is still entitled to medical care. The facts of each case are different but it sounds like your attorney knows what he is doing.
