Legal Question in Credit and Debt Law in Georgia

Real estate collections

I have a past due account in collection that came from not paying rent. The collector stated they will garnish my wages if not paid. I have not refused to pay, but i would like to know the laws that govern this issue especially it being real estate related (1 month rent for apartment). This was incurred cause i bought a house and did not have money to pay an extra month rent which incurred as penalty for cancelling my contract

Debt Collection Response

There may be violations of the Fair Debt Collection Practices Act. This statute is applicable under the appropriate case whether or not you owe the alleged debt. The debt is a separate matter from the method in which the collection agency collects on the debt. If the collector states that it has a right to do something and it in fact does not, that can be a violation. However, you did not provide enough facts for me to assess if the collector has done anything wrong. You can either e-mail, call me (404-267-1840 ext. 232), or contact another attorney and provide the attorney with more information in order for the attorney to make an assessment.
