Legal Question in Credit and Debt Law in Georgia

I had a thyroidectomy in 1996. I was 20 years old with an inconsistant part time job and no insurance. I now have skin cancer that I have to have surgery to remove. My dermatologist made an appointment with a surgeon and his office called back to say I owed $1,000.00 from 1996, apparently his partner did my surgery then and he is retired. They said they turned if over to collections. I was 20, I never knew I had the bill. They are refusing to do my cancer removal until I pay they money. The hospital wrote off my surgery under indigent care. Is there a statute of limitations in Georgia on a medical bill 20 years old?

This is not a statute of limitations issue. They can't make you pay.

However, there is no requirement that any doctor treat you, so you'll need to find another doctor. That's pretty much the norm when a doctor or hospital loses money on a patient; they'll never treat you in the future.

I agree with Attorney Ashman in large part. There is a statute of limitations; it is 6 years and runs from the date of your last payment or the date treatment was rendered. However, as Attorney Ashman correctly notes, no doctor is obligated to treat you at all and regardless of whether a debt is barred by the statute of limitations, I have a saying "once a debt always a debt." Debts last forever. There is an obligation to pay the debt once it is incurred. The statute of limitations is only a court defense - if you are sued, you must raise the defense in an answer or else its waived. The defense only prevents legal enforcement of the debt in court. It does not make the debt unenforceable.

So you have two choices - either pay up if you want the same doctor/surgical practice or do not pay and find another doctor. While I am sorry for your condition, those facts don't change anything or create a loophole. Your choices are the same. Either pay or go elsewhere. Not trying to be mean or insensitve here but it is unfortunately the world in which we live in. Thee are other doctors in most cases.
