Legal Question in Family Law in Georgia

Re: prenuptial agreement. I have a question regarding the validity of the agreement if the terms were not adhered to. Spouse 1 creates agreement for spouse 2 to sign. Spouse 1 agrees to provide life insurance policy for spouse 2 with spouse 2 named as sole beneficiary. Spouse 2 dies and it is discovered that no insurance policy was ever purchased. Is prenuptial agreement still valid? Who represents deceased spouse in such contest?

Your post contains insufficient information. No one could analyze the validity of the agreement without reading it. Whomever is the deceased spouse's heir (which depends on her will or lack thereof) might have rights, which may or may not add an additional problem since the spouse could be one of the heirs.
