Legal Question in Real Estate Law in Georgia

Dispute with landlord over proper notice and penalty

I am currently in an apartment with a 6 month lease. We moved into the apartment while we were having a house constructed. When I signed the lease I was under the impression that I would only be required to give 30 days notice before vacating. I gave them 45 days notice, and was then informed that since I had not given 60 days notice, I would be required to pay an additional month's rent.

The lease states this, but it also states that the management companies ''Good Neighbor Policy'' (an addendum) is legally binding, even though it is an unsigned document.

The ''Policy'' explicitly states 30 days or more notice (in very large print, as opposed to the need-a-magnifying-glass font used on the lease.

In addition, I was informed verbally of the 30 day notice (the lease states that verbal agreements don't count; only what's in the lease).

In my opinion, I should not be required to pay the penalty, because of the conflicting documentation. Can someone please tell me what a judges opinion would most likely be?

Thanks!!!!!!!!

Based on what you say, it sounds like you gave plenty of notice. However, I would advise you to consult with a local attorney who can carefully (and with a lawyer's eye to see if you missed something) review the documents.
