''wrongful termination''

I was injured on the job and kept off of work for 9 months( no light-duty). I was released to work I worked for 1 day and re-injured myself. Company fired me next day said I violated attendance policy (not true I have proof). Union and company are keeping me out because of my being disabled with permanent restrictions. E.E.O.C. issued right to sue. Do I have a case even though E.E.O.C. did not pursue? Thank You
