Legal Question in Consumer Law in Illinois

Break legal contract

My sister and her friend signed a joint account and purchased a car. Her friend turned on her and confiscated the car completely. Therefore, my sister is no longer entitled to the car....

Is there a way she can BREAK the legal contract by removing her name from the legal contract? What advice can be given...

Your help is appreciated! Thanks!

Re: Break legal contract

I am not certain what you mean when you state that your sister "signed a joint account and purchased a car." If your sister and her friend both signed the purchase contract and the retail installment order, then both of them would be equally liable for the purchase of the vehicle if there is a default in payments. Seeing that both parties purchased the vehicle together, your sister has a legal right of 100% ownership for the vehicle. Without being able to see the purchase documents, your sister may be a cosigner or guarantor for the purchase. Since the title is in joint tenancy, your sister may have a right to receive money for half of the value of the vehicle since she is pretty much barred from using it by her friend. You sister should seek an attorney to help her out since she may an action against her friend.
