Loan repayment

I have a legal matter that needs attention promptly. Back a year ago i loaned my finacee at the time $4,000.00. He and i signed a hand written agreement of which entailed the amount , the date, the date it would reach maturity and a clause stating that if he didn't pay the loan back i would take legal actions to persue the matter. Both of us signed and agreed to the terms. He and i have a copy of the agreement. I also have a copy of the check i gave him of which was the method of payment on the loan. Till this day of which is past the maturity date he has not repaid the loan nor has he made any type of attempt to contact me since he is long gone out of my life. What can i do? Can i take him to small claims court and get my money?

You can certainly sue him for the return of the money. Whether or not you can sue him in small claims court will depend on the court rules in the county where he or you live. When you are referring to "small claims" court you maybe referring to a court where you can sue him without a lawyer. Again the amount that governs this court is dependent on local court rules. Check with the clerk of the circuit court where you live and act accordingly.
