Legal Question in Criminal Law in Illinois

Judge Refuses Transcript request

I have a question regarding a trial that is currently in the jury deliberation stage of the trail.

The 12 jurors in Tony Rezko's corruption trial sent a note to Judge Amy St. Eve asking if she could give them a transcript of testimony from a witness named Michael Winter.

Winter's testimony is relevant to the first count in the indictment -- though it is a lengthy count involving a complex scheme.

In denying the jury's request, St. Eve said it isn't her practice to give jurors transcripts. The note back to jurors told them they couldn't get Winter's testimony or anyone else's

Is this commonplace for a judge to deny a jury's request for a transcipt of testimony. In this case there have been dozens and witnesses called, and Mr. Winter's testimony came nearly a month ago.

It seems that the jury would be better served if thier request was granted. So again, is this common place for a judge to deny such a request?

Re: Judge Refuses Transcript request

A denial of the jury's request for transcripts is commonplace. The jurors must rely on their memory.
