Legal Question in DUI Law in Illinois

DUI Law

I received a DUI .102 just this last weekend. First I was actually confident that I would not blow over the legal limit because I was drinking from a pitcher (hard to judge) but felt that I only had a total of 7-8 beers over a 4 hour period. When they brought me back for processing , while waiting I had a coughing fit. I recall when I was Military Police that if we were to give a breathalyzer to someone they could not spit or cough otherwise we would have to wait for 20 minutes. I am wondering if this is standard for all areas and if it could attribute to my blowing over the limit.

Re: DUI Law

No. You are over by .022 anyway. It's time for a DUI attorney. There may be other issues with the stop that could help your case.
