Legal Question in Family Law in Illinois

A judge in divorce court told me that he agrees the court lost jurisdiction over my case due to improper service and violating the statute; so judgments are void; this relates to my minor daughter now that the Court has lost jurisdiction what I am suppose to do to get my minor daughter age 12 released from my eldest daughter's care? I don't have a case anymore so how do I get the eldest to release my minor child to me ? The father passed away about 4 months ago.

I'm sure the Judge gave you leave to refile. All you have to do is refile your case and this time get proper service. I don't know what you mean by violating the statute but any problems there also have to be corrected with a refiling. You should hire a lawyer familiar with the Cook County Court Rules and Procedures to assist you. Good luck.
