Legal Question in Medical Leave in Illinois

fmla

I was told that I can not start my fmla until all my vacation is used up. This is their new policy, but won't give it to in writing. Can they do this? I have had fmla for 2 years, my application for this year was due Dec. so they can review it for approval in Jan. So far they have given me approval papers.

I wonder if you misunderstood. Is it possible that what you were told is that any accrued but unused vacation will be first applied against your FML? That means that some of your FML (that covered by your vacation) will be paid, and the remainder is unpaid. This is allowed.
