Copyright and Trademark restrictions
I am currently writing a literary
criticism book on the Harry Potter
Phenomeon. I would like include
cover and interior illustrations as part
of the book. Does the creation of art
based on the ideas or concepts
presented in a literary work an act of
copyright infrindgment? If the
characters are covered under
trademark does the creation of art
based on the ideas or concepts
presented in a literary work a
violation of trademark law even if the
art differs completely from the
established images presented under
the trademark?

The devil's in the details, however. I highly recommend you retain a competent intellectual property attorney if you plan on pursuing this project.
