usps liability in traffic accident

I was injured in a traffic accident

caused by a postal employee

delivering mail on a rural route. She

was driving her personal car, and her

insurance has a disclaimer when

using it for usps work. She pulled in

front of me ( four way intersection,

she had a stop sign, I had right of

way ). My truck was totaled, and I

now suffer permanent back and leg

injuries that threaten my

employment. I am 54 yo in

otherwise good health. What should I

expect in terms of a settlement?

If you have an attorney, you should follow his/her advice in recommending a settlement.

If you do not have an attorney, you should get one!

There is no way to recommend a number based on what you have written. As others have pointed out, the settlement amount is a function of 1) what you are willing to settle for; 2) your medical bills; 3) who are your doctors; 4) your diagnosis and prognosis;; 5) your lifestyle; 6) you employment and employment record; 7) the facts of the case; 8) the insurance company you are dealing with; 9) the forum in which you would file lawsuit if settlement negotiations fail; 10) and other factors.

There is a lot to consider and without an attorney, you don't even stand a chance to get any fair compensation for your injuries.

You will be able to file a claim against the USPS. The amount of your claim will be based on the following factors:

Pain and suffering, disability, past and future medical expenses related to the accident, past lost wages and future lost wages in addition to the property damage. If you are married and cannot do things at home, your wife may be entitled to compensation.

Any suit will have to be filed in an administrative claim against the USPS, first, then after 6 months a suit will need to be filed in the Federal District Court for the location where the accident took place if your case has not been resolved.

I know that you are looking for a dollar figure, but without having gone to the scene, or viewed the property damage and without having the information concerning your actual medical expense, lost wage, and medical records, a dollar figure can not be provided.
