Legal Question in Consumer Law in India

I had given a few clothes for ironing at a shop on 18/2/11 for which I have a receipt. I forgot about it totally and only now presented the bill for collection. Now, the shopkeeper is saying that since it is about 2 months, he cannot guarantee the clothes will be available. There is a line on the bill saying "Not responsible for clothes after 24 hours", but orally he says that they wait for 45 days before they bundle up the clothes and keep them separately. I have been following up with him for the past few days, but he says he needs more time to check. I asked him to give me in writing that I have already presented the bill, but he refuses to do that. I dont have the original purchase bills for the clothes.

What is my recourse for the lost clothes? Should I just approach the consumer court directly - I dont have anything except the bill as proof? Is there a time limit for such disputes.

Hi,

Is that a big shop ? If its a common small type shop, take help of police, in assisting you to get your cloths back, they won't mind helping you. If the shop is big and you can approach consumer court, but its also going to consume bit of your time. Rest you have to decide.
