Bill was issued but not payment by party. can it comes under summary suit?

If yes then why?

if terms and conditions are printed on the bill and the buyer has acted upon the bill say by signing it or making payment of some other similar bill or part payment, then it amounts to a written contract for the purposes of summary suit under order 37.
