Legal Question in Wills and Trusts in India

There was no agreement, the buyer paid the stamp duty just after the token that was not even 5 percent of the value of my flat.i told him i did not wish to sell my flat within two days of the receipt of the token and offered to return the token amount to him immediately .. he refused to accept and pressurized me to keep the deal. what must i do in such circumstances? should i serve him a notice along with the cheque of the token? there was not even a MOU.
