My husband and I are legaly seperated. I wanted to know if I could file bankruptcy on our house if it is in both our names? Thank you
He doesnt want to file bankruptcy.

Yes, you can file bankruptcy and include your obligation on a home loan, even if your husband does not wish to do so.
Be aware that bankruptcy law is changing dramatically in October, 2005. If you are seriously thinking about filing, you should contact someone immediately to see if you need to file before the law changes. Good Luck!
