Legal Question in Credit and Debt Law in Indiana

Settling with a former credit card company

I am being sued by a collections agency who has my account for a credit card. My court date is in the middle of December. I don't necesarily want to dispute the amount. How can I settle out of court or is it best to take to court? Can I settle for less than the amount? The court hearing is in IN but I live in IL.

Hmmm.... They should be suing you in the county in which you live. This could be a useful bargaining tool for you.

Call the collections agency and ask them if they are willing to talk about a settlement. As the previous attorney mentioned, you should tell them that you do not live in Indiana and will not consent to jurisdiction there. You should not tell them that you do not dispute the amount - let them think you will dispute it. If you can pay them in advance so they avoid going to Court, you may be able to save some money.
