Legal Question in Personal Injury in Indiana

my daughter while staying with me during a seperation from her partner crashed my car into the back of another car , not know she had to be on my Insurance while staying here the Insurance wont pay. I feel it is up to her to pay for the damages but she wont . do i have a case to file small claims against her?

Yes, if she is over 18, you have the legal right to sue your own daughter if she was at fault in damaging your car. Have both your ins. company and hers denied the claim?
