Hostile Work Environment

What determines if an environment is a hostile work environment or not? Is there such a thing as ''bullying'' and if so, does an employee have to ''take'' the bullying so long as the bullying is not based on race/sex/gender/etc.etc.?

Thanks for your question. Sorry to hear about your problems at work. Generally, hostile work environment comes into play in a discrimination or sexual harrassment setting. However, I am not aware that the doctrine would not apply if there is not discrimination. The problems are typically ones of proof of the bullying and then whether or not the amount of bullying is sufficient to cause a reasonable person to feel that they are being bullied. I would suggest you contact your supervisor, and if they are not sympathetic, their supervisor, and report the activity.
