Legal Question in DUI Law in Kentucky

second DUI

This is my second DUI Offense in 18 months and I don't know what to do. What will be my penalities? Should I obtain a lawyer or use a Public defender? How long I will lose my license? What will be the fine? Any additional information is greatly appreciated.

You should obtain a lawyer as there are serious consequences, including the possibility of mandatory jail time, loss of license, involved with a second d.u.i.

The minimum for a second offense DUI is 7 days in jail, $350.00 fine, 12 months loss of liscense, $250.00 service fee and alcohol treatment. If certain other factors such as refusal to take the blood test etc, are present, the jail time is increased. The Court does have descretion to allow service of the jail time on the weekends or allow work release. While the conviction on DUI is often sort of "cut and dried", an attorney is invaluable in working out the penalty and it is in this area that most folks have a problem. There are no hardship liscenses here. It is worth your while to have an attorney. Public Defenders do this every day and are quite good at it. If you do not qualify for a Public Defender, hire counsel. It is worth it. They know the law and you don't.

Nearly every time you go into court, you are better off with a lawyer. This is particularly true in a DUI case, and even more true in a case involving a charge that a second DUI was committed within a short time. Prosecutors are becoming increasingly hard on DUI offenders, following the legislature's lead when it increased the penalties for DUI.

You may have a defense to the charge. Even if you don't, the serious consequences you are facing make it important that you receive the best advice and representation possible.
