Legal Question in Family Law in Kentucky

Child custody & support modification another state

Previously, my son lived with his dad in Kentucky & we shared joint custody. I (his mom) live in Arizona & have paid child support. July 2005 my son moved to Arizona with me. This was agreeable to my ex-husband. My son is currently 15 years old & a high school student here.

What is the first step to modify the custody order, change my son's residence & further court activity pertaining to him to Arizona jurisdiction, and apply for child support to be paid by my ex-husband? Can I do this without an attorney? My ex-husband will definitely retain an attorney, but my finances are very limited & is the reason I haven't filed for modification in the past year.

I have tried researching this online but find the legal terminology overwhelming & unclear. Any information you can provide will be very appreciated.

Thank you in advance!

Re: Child custody & support modification another state

Child custodly issues are complicated and interstate custudy situations are more complicated. Most states have entered into varouis agreements concerning this matter. The first thing to realize is that while each case shares some common attributes, there are sufficient differences to make each one unique. Any agreement that you and your ex-spouse reach must meet court approval. There are several things that such agreements should address in light of your individual situations. The ONLY way to approach this is with counsel. "Do-it'yourself" projects in this area can (and more often than not) lead to disagreements and an uncomfortable environment for the child, especially a teen. You will not find much on the "web" to help you since most of these things are "custom" made. Good luck. there are so may folks that do nothing and lives are made miserable as a result. Seek the advise of a local attorney on a one to one basis. You will like the result.
