Is it legal to record someone without them knowing?

The laws differ from state to state and so you have to check the laws in whatever state you hope to record the conversation. In Kentucky, a conversation can be lawfully recorded as long as one party to the conversation knows about it. However, the next question is "what can the recording be used for?" Usually people want to use a recording in court. The rules of evidence dictate when and if a recording can be admitted as evidence and that is too complex an analysis for this forum, so it is wise to consult with an attorney about the specifics.
