Car Totaled by uninsured driver/recovering deductibles

My car was totaled (parked in my driveway) by a drunk driver who drove thru 2 lawns. There was also property damage to fencing and house. He was an uninsured, unlicensed driver but my insurance paid for everything except our $500 ded.

To recover the ded, can I take him to small claims and if so, can I recover any more $$'s than jsut the $500? He was arrested after and had a ba of 2.52

Your question leads me to conclude that you submitted the claim under your comprehensive auto coverage? Did you consider making a claim under your own uninsured/underinsured vehicle coverage?
