Legal Question in Family Law in Louisiana

If my husband admits to an affair and leaves our house to live with his adult daughter, does that meet requirement for physical separation? Because he had an affair, must I wait to file a petition of divorce?

You can get an immediate divorce based on the adultery.

You can file for a divorce immediately after he leaves, noting that you are entitled to a divorce based on being separated for 6 months after he was served with the Petition for Divorce. To get an immediate divorce because he committed adultery, you need more than him admitting to an affair. I do not know the Jurisdiction in which you will have to file, but please consult with an attorney in that Jurisdiction.
