Intestate succession

My father died with no will and he and his wife have a house that is community property. Does she have usufruct over the house and is there anything we can do about it? i.e. force her out?

If the house she is living in is community property and your father had no will, you can't force her out because of her usufruct.

She will have a usufruct until she dies or remarries.
