What are a persons consequences when being charged with a dui for the second time in less than a year.

You are possibly subject to enhanced penalties increasing the amount of maximum jail time possible. In all likelihood there would be actual jail time if you were found guilty, but probably not the maximum.

Penalties double for a second offense. 2 years in jail/ $2,000.00 fine. Plus, you cannot get probation before judgment. That means the motor vehicle administration will give you 12 points, which revokes your license. You should not go to court alone. Talk to a criminal attorney, like myself, for representation.
