can a biological fathers rights be terminated and another man be granted adoption rights if the biological mother is not married to the other man?

If the bio father contests the effort to terminate his rights, and can demonstrate some involvement (or at least an effort at involvement) in the child's rights, they will probably not be terminated. The marital status of the prospective adoptive father is not necessarily determinative, but could be a factor.
