Alimony

I know I just asked a question the other day in refernce to what monies I am entitled to from my ex, like retirement, 401K, and our savings he stole when he left. But as I was reading other questions and answers I came up with another question that I am not sure about. We have been going through mediation since September of 2007 and as it is coming up on a year since he walked out on us 3/23/07. What I want to know is if what is is offering me is legal. He say paying the mortgage and the household utilities, that he considers that my alimony and child support. I always thought that alimony and child support are separate from paying to keep a roof over his childrens heads and paying the bills, which I pay for half of some of the bills that come in. He only pays for electric, phone and mortgage. I pay for everything else. Including what the kids have needed since he left. He has not paid me anything toward the things the kids need, such as sports, and daugher school needs...etc. And with all the money he took was which a good part was our 2006 tax return that we just got before he left, he has spent about all of it. I have a lawyer and so does he plus we have a mediator/lawyer too. I am getting no where with either.

Re: Alimony

Paying the mortgage could be considered to be in lieu of alimony and child support, but whether that amount is sufficient to satisfy both obligations is another question. Your lawyer can explain to you how child support is determined, and alimony is based on the ability of the spouse to support herself, along with other factors.
