child support and custody

I have 2 children with my ex. We are suppose to have shared custody 50/50, the kids spent one week with him and one week with us. (my husband and I) He does not pay any child support because of this reason. My ex left the area in April 2007, which meant WE would have the children 100% of the time. He has since returned to the area after a year and a half. The children are still with us full time. But now he does not pay for anything. We do have a court order saying itis 50/50 but since we have had them 100% of the time for the past 2 years can we file for 1) child support with the court order that is now in place or do we have to file for full custody first? He never paid for the anything prior to this and we have. I have saved reciets for everything. I just need a starting point if you can help. Thank you.

You would need to file a Motion to Modify Custody, asking to establish sole custody and to request child support.
