If there is no existing court order for custody, you would need to file a Complaint for Custody in the Circuit Court of the County in which either you, the other parent, or the child reside. If there is an existing order, then you would need to file a Motion to Modify Custody. The current custodial parent may file a counter-claim for child support if one isn't already in effect.
