Legal Question in Family Law in Maryland

My fiancee bought a used car 2 years ago and we were in an accident in it within 3 months (not our fault). The insurance payment did not equal the amount still owed on the car. My fiancee continues to get phone calls from a collections bureau for the remaining balance on the car. When we get married, will I be held responsible for this debt? Thanks.

The loan company will likely continue to seek the money from your fiance. Presuming they go to court and are awarded a judgment, they may seek bank account and wage garnishments along with intercepting tax refunds. They cannot go after you, personally, after you are maried because it is not your debt. However, they can go after assets titled jointly between the two of you, including your tax refunds.
