Legal Question in Medical Leave in Maryland

MD - pregnancy & FMLA = less than 12 months of employment

Q: My daughter was hired in June '07 when she was about 5 months pregnant - due to give birth on 10/3. She had serious complications and the baby was born 9/11. She is being denied FMLA benefits - in fact, she has been terminated - and we would like to know if this is correct employee treatment according to the Maryland FMLA laws. Please advise?

Your daughter may have rights under federal and state laws. The federal law would not protect her employment since she didn't meet the time in job requirement. However, this does not affect the state law issue which will have to be addressed by an attorney licensed to practice in your state.
