Legal Question in Real Estate Law in Maryland

Property abandoned June 8, 2011 by ex-fiance. We are both on the Deed and the loan. My daughters and I are still in the home. I've been paying my half and his for a year and six months now with out any support from my ex-fiance. Loan modification has been in place but he will not sign or remove his name from the Deed and or loan. How can I get his name off of the Deed and or loan?

There is no simple way to remove someone off a Deed if they are unwilling to do so voluntarily. The law does allow a joint owner to force a sale (by a lawsuit called in sale in lieu of partition). This is designed to force a sale when one party won't cooperate but in many cases forces a buy-out. To remove someone off a loan, the lender must approve.
