Legal Question in Business Law in Massachusetts

My website offers free advertising to businesses. My concern is that someone will post a false ad for a business. The business will then seek legal repercussion from me for allowing an ad to be posted on my site that was not authorized by them. How do I authenticate my ad submissions and/or protect myself legally from those who might submit a false ad?

You need a disclaimer on your website for the ads and you need an authentication program for confirming the ads are correct and they are who they say they are.

You also need a policy on removing ads that is accepted at the time of uploading an ad. I suggest you contact a business attorney such as myself to review your agreements and disclaimers or to prepare them for you.

Good Luck.

You need to make the advertisers agree to terms and conditions in order to advertise there for free; saying you have no actual or apparent oversight over or responsibility for the advertisers. Also post a disclaimer statement on public areas of your site. Additional steps are recommended; look into it and protect yourself.
