Legal Question in Civil Litigation in Massachusetts

Cease and desist

My brother keeps bothering me with mail, e-mail, and phone messages which are very insulting and offensive. (''You're a piece of shit.'', that kind of thing.) Do I have any legal recourse to get him to leave me alone?

If his actions are placing you in "fear of imminent serious physical harm" then you are able to file for a domestic abuse restraining order (209A). If he contacts you after that by any method, he will be arrested and charged with a serious crime.

You have two (2) avenues:

1. File a civil suit in the Superior Court. I am not sure whether there is a way to avoid filing fees.

2. File a request for issuance of criminal process for misdemeanor harrassment in the local District Court. THis will cost about $15.00, and the matter will be brought in front of a clerk-magistrate.
