civil case-who to sue?

A driver with a suspended license hit me on Oct. 19, 2006. She did not own the car.The car was owned by another woman who was not the driver. When I called her insurance company they informed me that her insurance had lapsed on 9/2006. Who do I sue to get my money back on the cost of the rental car?

YUou can sue the owner, assuming she gave this driver permission to drive or use the car, and you can sue the driver. You may also be able to recover from your own insurer.

You sue both! Both are liable to you for negligence.
