Legal Question in Civil Litigation in Massachusetts

CSE/DOR - payroll deductions

I currently have medical insurance for my child via my current wife. MA CSE / DOR instructed my employer to enroll myself for family coverage when coverage already exists. I have or was not asked nor do I know if the ex was asked if medical coverage exists on the minor child. I found out that they ordered my employer to deduct when I received my check minus $105/++. No one had asked for verification of med coverage. There was no notification given to me by my employer or by CSE/DOR. How can we take action against them for orderng monies fraudenlently. No notice was sent monies deducted and med coverage already in place. Now there are two medical coverage policies. I would like to make a difference for those of us that do what we are suppose to do and stop the harrassment by this agency.

Please let me know what laws protect men like me and what can I do to stop the harrassment.

Re: CSE/DOR - payroll deductions

You need to file a modification action with the court to get DOR's "order" rescinded.

Please look at this with perspective, though. Many, many NCP's, most of them of the male gender, are absolutely despicable where support and medical coverage are concerned. DOR/CSE wouldn't have this mandate were this not so.

Please feel free to call if I can assist further.

If you were represented by an attorney, ask that attorney to contact DOR/CSE to determine whether this was in fact a mistake or whether the Court did, perhaps, order you to provide the health insurance for the children to replace that provided by your former spouse through her employer, for some reason. If it was not simply a bureacratic error, your attorney may need to seek a modification of the court order. Good Luck!
